1. INTRODUCTION AND SCOPE

This Consumer Health Data Privacy Notice (“Notice“) describes how Health Union, LLC (“Health Union,” “we,” “us,” or “our“) collects, uses, shares, and processes Consumer Health Data through our Sites and Services. This Notice supplements our Privacy Notice available at https://health-union.com/privacy-notice/. and is provided pursuant to the Washington My Health My Data Act (RCW 19.373) and the Nevada Consumer Health Data Privacy Law (NRS 603A.400 to 603A.550).

Capitalized or defined terms not explicitly defined in this Notice shall have the meanings ascribed to them in our Terms of Use and Privacy Notice. Please read this Notice carefully to understand our policies and practices regarding your consumer health data and how we will treat it. If you do not agree with our policies and practices, you should not use the Sites and Services linking to this Notice.

2. CONSUMER HEALTH DATA WE COLLECT

“Consumer Health Data” means Personal Information that is linked or reasonably linkable to a consumer and that identifies the consumer’s past, present, or future physical or mental health status, condition, or diagnosis, including but not limited to gender-affirming health data and reproductive or sexual health data.

We collect the following categories of Consumer Health Data:

• Individual health conditions, treatments, diseases, or diagnoses, such as the interest in or viewing of articles that relate to or are used in connection with the treatment of a specific health condition.
• Social, psychological, behavioral, and medical interventions, such as the interest in or receipt of certain preventative medications or health products.
• Diagnoses or diagnostic testing, treatment, or medication, such as interest in or purchase of specific medications or diagnostic tests, or search queries regarding specific diagnoses or treatments.
• Receipt of health-related surgeries and procedures or post-surgery or procedure care, such as participating in forums to discuss operations and post-operative activities.
• Gender-affirming care information, such as the interest in and review of articles that relate to or are used in connection with such care.
• Reproductive or sexual health information, such as an interest in reproductive or sexual health medications or products, including contraceptives.
• Data that identifies a consumer seeking health care services, such as search queries to find or locate a medical doctor, or concerning medical conditions or other health-related topics.
• Information derived or extrapolated from non-health data that reveals or could be used to identify a consumer’s health status.

3. SOURCES OF CONSUMER HEALTH DATA

We collect Consumer Health Data from the following sources:

• Directly from you: When you create an account, participate in community forums or discussions, respond to surveys or questionnaires, submit content or stories, or communicate with us via email or other channels.
• From your interactions with our Services: Through your browsing activity, page views, search queries, content engagement, and interactions with health-related articles and community features on our Sites.
• From third-party sources: From advertising and data partners who provide audience and interest data, and from publicly available sources.

4. HOW WE USE CONSUMER HEALTH DATA

We collect and use Consumer Health Data for the following purposes:

• Providing, maintaining, and improving our Sites and Services, including tailoring our online health communities to present relevant information to you.
• Understanding and analyzing how users interact with our Sites, including analyzing traffic and usage metrics, and how users search for, choose, and interact with various pages or features.
• Marketing our content, Sites, and Services to current, former, and potential users.
• Preventing and detecting fraud, financial crime, hacking activities, security breaches, and other unlawful activities in connection with our Sites and Services.
• Protecting Health Union and its parent companies, affiliates, and subsidiaries, including investigating possible fraud, theft, violations of our Terms of Use, or misuse of our Sites.

5. HOW WE SHARE CONSUMER HEALTH DATA

We share Consumer Health Data with the following categories of third parties for the following purposes:

6. HOW CONSUMER HEALTH DATA IS PROCESSED

Consumer Health Data is processed electronically through our web-based platform and the systems of our service providers. Processing activities include:

• Storage in encrypted databases hosted in the United States.
• Analysis for content personalization and audience segmentation to deliver relevant health information through our community Sites.
• Transmission to service providers via cookies, pixels, and API integrations for advertising targeting and measurement.
• Anonymization or aggregation for research and analytics purposes.
• Use by our internal teams to improve the content and functionality of our Sites and Services.

7. THIRD-PARTY DATA COLLECTION ACROSS SITES

Health Union does not provide personal information, including Consumer Health Data, to third parties for the purpose of tracking you over time and across different websites and online services.

8. YOUR RIGHTS

Subject to applicable state law, you may have the right to:

• Confirm and Access: Confirm whether we are collecting, sharing, or selling your Consumer Health Data, and to access such data, including a list of all third parties and affiliates (with active contact information) with whom we have shared or sold the data.
• Specific Third-Party List: Request a list of the specific third parties to whom we have sold any consumers’ Personal Information.
• Review and Request Changes: Review the Consumer Health Data we have collected about you and request changes or corrections to inaccurate data.
• Withdraw Consent: Withdraw your consent to the collection or sharing of your Consumer Health Data. Where consent is the basis for processing your Consumer Health Data and where law permits, you have the right to withdraw your consent to such processing.
• Delete: Request deletion of your Consumer Health Data.

Where the collection or use of your Consumer Health Data is necessary for us to provide a product or service you have requested, we may collect and use your Consumer Health Data for that purpose without separate consent. For other purposes, we will obtain your consent where required by applicable law.

9. EXERCISING YOUR RIGHTS

11. CHANGES TO THIS NOTICE

If we make material changes to this Notice, we will notify you by email (if you have provided an email address through an account or subscription) or by posting a prominent notice on our Sites before the changes take effect. We will not add new categories of Consumer Health Data we collect or new purposes for collection, use, or sharing without first disclosing the changes and obtaining your affirmative consent prior to any such collection, use, or sharing.
